These Terms of Use ("Terms") govern your access to and use of the website at bitusercloud.com (the "Site"), operated by Diggen Corporation, doing business as Bituser ("Bituser," "we," "us"). By accessing or using the Site, you agree to these Terms.

These Terms cover the website, not the platform service

Your access to and use of the Bituser platform and services is governed separately by a Subscriber Agreement and applicable Order Form. To the extent of any conflict regarding the paid services, the Subscriber Agreement controls. These Terms apply to use of this public website.

01Acceptance of terms

By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site.

02Eligibility

You must be at least the age of majority in your jurisdiction and able to form a binding contract to use the Site. If you use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

03Permitted use

You may use the Site for lawful purposes and in accordance with these Terms. You agree not to:

  • Access, scrape, or harvest the Site or its content by automated means without our consent
  • Interfere with or disrupt the Site, its security, or its underlying systems
  • Attempt to gain unauthorized access to any account, system, or data
  • Reverse engineer or copy the Site except as permitted by law

"Bituser," the Bituser logo, and related marks are trademarks of Diggen Corporation. Except as expressly permitted, you may not use, copy, or distribute any content without our prior written consent.

The Site may link to or integrate third-party tools and services. We are not responsible for the content, policies, or practices of third parties, and your use of them is subject to their own terms.

06Disclaimers

The Site is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.

07Limitation of liability

To the fullest extent permitted by law, Bituser and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100).

08Indemnification

You agree to indemnify and hold harmless Bituser and its affiliates, officers, and employees from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Site or your violation of these Terms.

09Governing law & dispute resolution

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by JAMS in San Francisco, California, in accordance with its rules, except that either party may seek injunctive relief in court for intellectual property or unauthorized-access matters.

To the extent permitted by law, disputes will be resolved on an individual basis, and you waive any right to participate in a class or representative action.

10Changes to these terms

We may update these Terms from time to time. We will revise the "last updated" date above, and material changes may be communicated through the Site. Your continued use after an update constitutes acceptance of the revised Terms.
